Driver Logging Compliance Regulations Overview: Canadian ELD Mandate

The FMCSA’s mandate requiring commercial vehicle drivers such as commercial truck and bus drivers to utilize electronic logging devices (ELDs) in recording their record duty statuses. Rather maintaining a Record of Duty Status (RODS), Canadian truck and bus drivers will require the use of an on-board electronic logging to comply with the Canadian ELD Mandate. The Canadian government is planning to implement rules that are similar to the mandate of the United States.

The new legislation attempts to replace the use of manual data entry which has been in existence since 1930’s. The Canadian ELD mandate eliminates traditional methods of keeping track record duty statuses and begin using an on-board electronic logging device also referred to as (ELDs) to minimize driver-errors and driver coercion. The Canadian ELD mandate essentially minimizes risky driving behaviors caused by driver-errors and also lessons erroneous dispatcher decision-makings that flags officials for compliance audits.

  2. Time Constraints. The Canadian ELD mandate is drafting drivers deadline to comply as it nears the end of 2017. To avoid out-of-service orders drivers, carriers, and fleets are encouraged to begin transitioning to ELDs before implementation deadline
  3. International Borders.  Canadian commercial truck/bus drivers operating oversized vehicles across the southern border will be required to comply with U.S. Federal Regulations mandating the use of an on-board electronic logging device by December 2017 to maintain duty statuses. Canadian carriers based in Canada, have no exemptions to the rule when cross-border trips and deliveries on U.S. soil are required to comply.
  4. Privacy. Driver harassment and privacy are central to ELD specifications. In connection with the FMCSA’s mandate, every driver should be able to access his records upon request and log their non-driving time. There is also a need to approve any logs that the carrier wants to add. ELDs must have a feature to mute when they are having their nap time and make the driver’s’ personal time less visible. GPS radars must continue to scan wider limitations.
  5. Tamper resistant. Every captured data recorded should include a code combination of vehicle mileage, time record and location coordinates. By implementing this method, it is easy to verify the authenticity as well as increase difficulty in data fabrication.

Carriers and truck drivers should be more careful in choosing the ELD provider to use. Canadian carriers should ask a variety of questions and not stop until they find the best one. Among the questions carriers should ask are the availability of solutions for the device’s use until 2019;  the accessibility of staff with sufficient technical understanding of the regulation; if ELD provider has history working with the FMCSA and ELD regulatory process, and if it can provide the needed financial resources to continue with the necessary ELD product updates.
